Your Brain in Court: Cognitive Privacy, US Constitution and Neuroimaging

Neuroimaging techniques, like fMRI, present constitutional dilemmas for criminal law and criminal procedure, according to University of Maryland‘s Amanda Pustilnik.

These technologies raise questions about “cognitive privacy” in relation to “compelled, self-incriminating speech” under the United States Constitution’s Fifth Amendment and “unreasonable search and seizure” under the Fourth Amendment.

Neuroimagery technologies can measure brain blood flow to determine whether the person is making false statements, and can evaluate whether waveform brain activity indicates a person is familiar with an object like a face or weapon.

In addition, these measurement devices can alter brain processes, such as exposing the brain to powerful magnets, resulting in greater or lesser likelihood of offering truthful statements.

Recent Eighth Amendment challenges to execution by lethal injection and legislative restrictions on abortion based on putative fetal pain are additional examples of legal questions informed by neuroimaging technology.

In these cases, neuroimagery measurements can provide evidence of presence and degree of physical pain.
Previously, this subjective state has not been directly observable until pain neuroimaging procedures were developed and admitted as legal evidence.

Pustilnik proposed “embodied morality” to explain how moral concepts of legal rights and duties are informed by human physicality and constrained by observers’ limitations in empathic identification with the pain sufferer’s experience.

U.S. law applies unrealistic criteria to determining defendants’ mental states for criminal trials in light of neuroscientific evidence, she argued, noting that the law maintains “a false trichotomy” among cognition, emotion, and volition to determine whether a defendant was “capable of moral agency” in committing an illegal act.

This decision is based upon whether the admissible evidence demonstrates that the defendant acted with “purpose,” suggested by planning the act in advance and “knowledge” of the act, typically determined by the defendant’s statements.

Pustilnik cited examples of disorders in which emotional impairments and volitional impairments can modify cognition, including temporal lobe injury, drug addiction, and obsessive-compulsive disorder.

In these situations, the defendant may provide an intelligible “explanation” of the act, yet may not be able to control the behavior, as in obsessive-compulsive disorder or drug addiction.
If the criteria of “intent” and “knowledge” are not fulfilled, a defendant may claim to have acted under “diminished capacity.”

To remedy this disconnect, Pustilnik recommends investigating whether the defendant  “understands the wrongfulness of the act.”

Widener University’s Jean Macchiaroli Eggen and Eric Laury of Minor and Brown echo Pustilnik’s observations and propose applying neuroimaging evidence to elements of tort law including knowledge, intent, negligence, and recklessness.

Critics of the admissibility of neuroimaging evidence like Bernard Baertschi of University of Geneva raise concerns that neuroimagery evidence injecting a systemic bias that influences jurors’ evaluations of defendants.

To test this claim, Nick Schweitzer and Michael Saks
 of Arizona State University investigated decisions by nearly 1200 volunteers in a mock trial involving psychological, neuropsychological, neuroscientific, and neuroimage expert evidence.
Participants evaluated the defendant’s claim of Not Guilty by Reason of Insanity (NGRI).

Volunteers said neuroscience evidence was more persuasive than psychological and anecdotal family history evidence, but there was no significant effect for neuroimaging evidence.

The researchers also asked participants to apply different insanity standards, and neuroscience evidence remained most influential across all standards.

Mock jurors who were not provided with a neuroimage said they believed neuroimagery would have been the most helpful evidence in evaluating the defendant, although those who actually received neuroimagery data did not judge this evidence as most valuable.
This is another example of forecasted judgments not correlating with actual judgments.

Neuroimaging skeptic Bernard Baertschi evaluated whether Functional Magnetic Resonance Imaging (fMRI) is more reliable than the polygraph to determine whether a person is providing truthful statements.

He outlined technical, methodological, conceptual and legal issues that obscure the conclusion, including technical definitions of lying and legal concerns about potentially biasing effects of brain imaging evidence on lawsuits.
He concluded, “Mind-reading using fMRI is not ready for use in the courts.”

Body Language Conveys Emotions more Intelligibly than Facial Expressions

Numerous studies, pioneered by Paul Ekman of University of California, San Francisco, argue that facial expressions provide an accurate, consistent, universal “tell” to underlying emotions.

However, body language more accurately conveys intense emotions than facial Ekman Emotion Stock photoexpressions, according to Hebrew University’s Hillel Aviezer,Yaacov Trope of NYU, and Princeton University’s Alexander Todorov.

Three groups of 15 people judged intense emotions, including pain, pleasure, victory, defeat, grief and joy, portrayed in stock photographs of:

  • facial expressions alone or
  • body language alone or
  • both facial and body expressions.

Volunteers assigned more accurate inferences of pictured emotion based on body language, alone or combined with facial expressions, than judgments based on facial context alone.

These results challenge presumption that the face best communicates feeling, yet most participants believe that they rely on facial expression was their most important cue in making inferences.

More than half the volunteers reported that they use facial expression to judge underlying emotions, a bias labeled “illusory facial affect” by Aviezer and team.

Some participants did not view the photos, but heard a description of the content.
The vast majority – 80 percent – said they “would” rely solely on the face when determining the emotion.
The remainder said they would consider the face and body together, yet not one participant indicated that body language alone would be the most important guide to emotion.

Another experiment presented volunteers with altered photos that combined one intense emotional expressed in the face with an opposing “peak” emotion portrayed by the body language.
Volunteers more often judged the emotion associated with the body, although they thought that facial expression was more indicative of underlying emotional experience.

A different condition demonstrated that most participants provided inaccurate judgments of six emotional states portrayed by faces alone:  They judged positive facial expressions as negative more frequently than the actual negative expressions.

Aviezer, Trope, and Todorov argue that facial expressions can be ambiguous and subjective when viewed without the context of body, particularly during intense emotional expressions.

Jamin Halberstadt of University of Otago explained Team Aviezer’s findings by noting “…bodily context is the expression of emotion…the face reveals a general intensity of feeling but doesn’t communicate what the person is feeling exactly. The body is where the valid information comes from during intense feelings.”

His expertise is based on earlier research with University of California at San Diego’s Piotr Winkielman, Paula Niedenthal of University of Wisconsin and University of Clermont-Ferrand’s Nathalie Dalle.
They demonstrated the important role of expectancy in reading, experiencing, and recalling emotions expressed by ambiguous facial photographs.

Halberstadt’s team used electromyography (EMG) to evaluate volunteers’ muscle mimicry responses and memory of photos portraying ambiguous faces when associated with emotion labels like “angry” or “happy”, and when the same photos were presented without labels.

Participants displayed more EMG activity associated with smiling when they viewed faces labeled “happy” than “angry,” and remembered faces labeled “happy” as happier than faced coded “angry” even though the photographed expressions were ambiguous.

When participants spontaneously mimicked emotions labeled with a specific affect label, they were more likely to remember this emotion.
Since the photos were ambiguous, this recall represents memory bias, based on expecting, then mirroring an expected emotion. 

SPOT-Dept Homeland SecBody language’s greater accuracy than facial expression as a measure of emotion, has important implications for mission critical interrogation and security-screening techniques.

One example is the U.S. Transportation Security Administration’s Screening of Passengers by Observation Techniques (SPOT) program, which was based on Ekman’s facial expression research, but did not account for bodily expression as an indicator of underlying emotion.

Team Aviezer’s findings argue that emotion-screening procedures, as well as everyday workplace interactions, should evaluate both cues from both the body and the face to form most accurate judgments of others’ likely emotional states.

Biased Time Perception – Mind Time, Clock Time, and Einstein

Eminent physicist and everyone’s favorite genius, Albert Einstein, suggested that most people have a biased perception of time: “The distinction between past, present and future is an illusion, although a persistent one.”

More than half a century after Einstein’s groundbreaking theories of relativity a pioneering psychologist   Rorschach expert Molly Harrower illustrated the emotional component of time perception in a poem she wrote during a time of personal transition and loss:

Zimbardo became well-known following the disturbing results of the Stanford Prison Experiment, and later began investigating subjective Time Perspective (TP) using a self-report inventory

They identified six time perspectives:

  • Positive Past
  • Negative Past
  • Hedonistic Present
  • Fatalist Present
  • Future
  • Transcendental Future

Philip Zimbardo - Ideal Time PerspectiveZimbardo and Boyd suggested an optimal orientation to time includes a calibrated perspective across the six time orientations.

Citing his own childhood in the South Bronx, Zimbardo argued that schools convert Present Hedonists into Future-oriented time perceivers, and increase opportunities for economic advancement.

Robert Levine of California State University, Fresno, differentiated among measured time and subjective time by defining:

  • Clock time
  • Event time
  • Natural time

He asked how people use time in different regions, and the impact of these choices on relationships and health.
Like Zimbardo and Boyd, he advocates developing the ability to move across time orientations and time-related behaviors.

Some of these time perspectives can include subjective biases, including an “elastic” experience of time – sometimes shorter or longer than clock time, according to the BBC’s Claudia Hammond.

She identified several biases in time perception, such as overestimating elapsed time during a frightening experience and shortening of perceived time during a pleasant experience or as one ages.

One explanation for the feeling like time accelerates as one gets older is the “proportionality theory“, according to University of Groningen’s Douwe Draaisma.

In this view, a year – 365 days most years – can feel brief when one is 40 years old and has already lived almost 14,600 days.
The same year might feel longer to an 8 year old who had lived almost 2920 days, because it is a larger proportion of experienced time.

Another time perception bias is “forward telescoping,” the feeling that past events occurred more recently than they actually did, according to Lehman College’s Vincent Prohaska with colleagues Norman Brown and Robert Belli.
Reverse telescoping” refers to past events of the same elapsed time that seem to have taken place even longer ago.

The Holiday Paradox is another time perception anomaly in which time away from one’s usual routine feeling like it passed both quickly and occurred over a long period of time, perhaps due to the concentration of new experiences and the need to concentrate on processing novel information.

Similarly, “Reminiscence Bump” enables many people to recall experiences between 15 and 25, including prominent news events and cultural trends including music, attire, interests.

University of Chicago’s Norman Bradburn suggested that these distortions may occur because many experiences during memorable or “critical” developmental periods are usually novel, distinctive, personally-involving, and emotionally-tinged.

Because these events were memorable, they may seem to have occurred more recently because people often associate clearer memories with more recent occurrences.
This “inner chronometry” of time tracking can be distorted by emotions, attention, expectations, task demands, and even ambient temperature, according to “the Clarity Hypothesis” to explain these perceptual biases.

Role Pioneers May Encounter “The Glass Cliff”

Holding a role usually occupied by the other gender can lead to significant media coverage, such as Sally Ride’s selection as an astronaut or Marissa Mayer’s appointment as CEO of Yahoo while in the later stages of her first pregnancy.

However, incumbents of roles usually held by people of the other gender can evoke harsh judgments about competence and suitability for leadership roles, according to Yale’s Victoria Brescoll and Erica Dawson with Eric Luis Uhlmann of HEC Paris.

This effect was most noticeable when both male and female leaders in “gender-incongruous” roles made minor errors in experimental studies.
Both male and female evaluators judged minor mistakes as indicators of role incompetence when male and female leaders held jobs typically performed by the other gender.

Brescoll, Dawson and Uhlmann suggested that “gender-incongruous” roles are seen as “ambiguous” by observers, leading to uncertainty, and negative assessments to “restore implicit order.”
The team referred to this rater bias as the “glass cliff effect.”

The researchers concluded that “the high status and senior leadership achieved by both men and women in gender-incongruent roles is fragile, vulnerable and unstable.”

This effect may be due to both the role’s gender incongruity and high status.
An earlier blog post highlighted Alison Fragale’s demonstration that higher status individuals are judged more harshly than lower status people when they make the same mistakes.

Her team at University of North Carolina found that observers in two experiments attributed greater intentionality, malevolence, self-concern to the actions of high status wrongdoers – and recommended harsher punishment for the same actions that earned lower status people “the benefit of the doubt.”

Although Brescol, Dawson and Uhlmann did not offer recommendations to mitigate the risks of being a pioneer in holding non-traditional job roles, Fragale’s team found that high status wrongdoers could protect from the impact of subsequent mistakes by demonstrating, warmth and concern for others and engaging in charitable giving.

Other strategies to consider include:

  • Cultivating strong executive alliances and sponsorship
  • Assembling a risk mitigation team to provide expert messaging during a crisis, focusing on external attributions of the error
  • Balancing demonstrated competence with the “humanness” of a small error
  • Offering plans for future action unrelated to the error to demonstrate decisive leadership and action-orientation.

Reduce “Affective Forecasting” Errors

People often make “affective predictions” about choice of life partner, occupation, residence, yet most everyone makes small, but systematic errors in forecasting personal emotional responses.

These misjudgments can negatively affect personal health, happiness, financial well-being, and interpersonal relationships.

University of British Columbia’s Kostadin Kushlev and Elizabeth Dunn identified these decision biases, and noted that one of the most well-known and widely-occurring affective forecasting errors is impact bias, the tendency to overestimate the intensity of emotional responses to future positive and negative events.

In addition, Kushlev and Dunn reported that people tend to overestimate the duration of future emotional reactions, labeled durability bias.

Durability bias (focalism) can occur when people rely on the “rational system” for information processing, according to Seymour Epstein of University of Massachusetts.

His Cognitive-Experiential Self Theory proposes that the “rational system” is used to make affective forecasts using slow, analytic and abstract processing.

Seymour Epstein-CESTIn contrast, the “experiential system” of information processing is rapid, associative, holistic, and concrete.

Shifts between rational (“cold”) and experiential (“hot”) decision systems can cause another bias, “Empathy gap.”

Epstein posits that rational system processing can lead to imagining the event isolated from its broader context, which can underestimate its emotional impact.
This can lead to focus on and overvalue distinctive, observable characteristics. 

Immune neglect is a related error, when people underestimate their likelihood of later reinterpreting future events to reduce regret.

Underestimating the power of future physical states is another predictive error recognised in Alcoholics Anonymous guidance to analyse whether cravings occur when people experience “HALT” (“Hungry, Angry, Lonely, Tired”.)
Personality neglect,” is another error that occurs when people underestimate the influence of personal dispositions and characteristics.

Expectations affect future emotions, according to Wilfrid Laurier University’s Roger Buehler, Vassili Spyropoulos and Kent C. H. Lam with Cathy McFarland of Simon Fraser University.  They found that those with positive expectations experience more positive present and future emotions. This optimism bias may provide protection and benefit to each individual’s “psychological immune system.”

People can reduce errors in predicting future emotions by evaluating expectations in comparison to actual experience during a “post-mortem” session to review “lessons learned,” found University of Alabama at Huntsville’s Kristin Weger and Sandra Carpenter.

Spreading Good News Feels Good, Especially When It’s About You

Christian Science Monitor has long provided a counterpoint to mainstream media’s “If it bleeds, it leads” approach to providing shocking, scandalous, depressing, or scary news.

Berger and Milkman evaluated a random sample of 3,000 of more than 7,500 articles published in the New York Times online from August 2008 to February 2009.

They judged each article’s “popularity” based on number of times it was forwarded to others, after controlling for online publication time, section, and degree of promotion on the home page.
Independent readers rated each article for practical value or surprise, and ratio of positive vs negative emotion words in each news item.

Most-forwarded posts were positive, funny, exciting and featuring intellectually challenging topics, like science, that “inspire awe” (“admiration and elevation in the face of something greater than the self”).

Readers shared articles that typically provoke negative emotions like anger and anxiety, but not sadness.

Michigan’s Emily Falk, with UCLA colleagues Sylvia Morelli, B. Locke Welborn, Karl Dambacher,and Matthew Lieberman found that people consider what appeals to others, possibly as a means of building relationships, indicated by increased activation in brain regions (temporoparietal junction, or TPJ and dorsomedial prefrontal cortex) associated with “social cognition,” or thoughts about other people, measured by fMRI.

When those regions were activated, people were more likely to talk about the idea with enthusiasm, and the idea would spread by word-of-mouth.

Falk noted that the team mapped  brain regions “associated with ideas that are likely to be contagious and are associated with being a good ‘idea salesperson.'”
She plans to use these brain maps “to forecast what ideas are likely to be successful and who is likely to be effective at spreading them.”

People also like to spread good news about themselves.
Diana Tamir and Jason Mitchell, then of Harvard, illustrated that brain regions associated with reward (mesolimbic dopamine system, including the nucleus accumbens and ventral tegmental area) are activated when people share information about themselves.

Self-disclosure is so pleasurable that people will sacrifice monetary rewards for this opportunity.

In fact, Rutgers’ Mor Naaman with Jeffrey Boase, now at Ryerson University and Chih-Hui Lai, now of University of Akron found that 80 percent of Twitter users tweet primarily about themselves.
One reason may be that people say more positive things when they’re talking to a bigger audience, like Twitter followers, according to Berger’s research suggests. As a result, social media users are likely to convey positive information about themselves.

However, this positive self-presentation may not result in a positive mood if communicators spend longer on social media platforms like Facebook.
Hui-Tzu Grace Chou and Nicholas Edge of Utah Valley University found that those with longer visits to Facebook say they are less happy than their Facebook Friends.

They found that Facebook users tend to form biased judgment based on easily-recalled examples (availability heuristic) and erroneously attribute positive Facebook content to others’ personality, rather than situational factors (correspondence bias), especially for those they do not know personally.

Corroborated by Humboldt-Universität zu Berlin’s Hanna Krasnova and her team from Technische Universität Darmstadt, these researchers observed “invidious emotions” and “envy” among people who spend longer time on Facebook.

These findings have relevance to members of the Word of Mouth Marketing Organization: Spread the good word – or at least the emotional word – and spend less time on Facebook and other social media that might invite social comparison and the potential for envious dissatisfaction.

“Grit” Rivals IQ and EQ to Achieve Goals

Emotional intelligence has been demonstrated to be a better predictor of achievement and performance than measure of intelligence.

One important component of Emotional Intelligence (EQ) is perseverance, the consistent, sustained and focused application of talent and effort over time, University of Pennsylvania’s Angela Duckworth.

She refers to this perseverance and passion for long-term goals as “grit” in her research with West Point cadets and Scripps National Spelling Bee contestants, in collaboration with University of Michigan’ Christopher Peterson and Michael Matthews and Dennis Kelly of United States Military Academy, West Point.

Grit was not related to IQ but was highly correlated with “Conscientiousness,” a personality trait described in the Five Factor Model of Personality.
It was also a better predictor of “success” as measured by retention at West Point, and advancement in the National Spelling Bee.

In addition, “grittier” participants:

  • Achieved higher levels of education
  • Had fewer job switches and career changes
  • Earned higher school grades than their peers, despite having lower standardized test scores measuring intelligence and achievement

Practice activities rated as more pleasurable and less effortful, like reading for pleasure, being quizzed by their parents, contributed less to spelling performance.

Parents and educators found responded enthusiastically to Paul Tough’s popularized summary of “grit” research in his book advising parents and teachers how to help young people develop grit, curiosity, conscientiousness, and optimism.
He “gritty” attributes highly correlated with successful academic and career performance.

Duckworth expanded the investigation of grit to include “explanatory style”, seen in individuals’ propensity to explain events from optimistic or pessimistic perspectives.
Explanatory style is evaluated according to whether the individual considers event causes as:

  • Personal (Internal vs. External cause or influence)
  • Permanent (Stable vs. Unstable)
  • Pervasive (Global vs. Local/Specific)

Optimistic explanatory style is characterized by external, unstable, local / specific explanations, whereas pessimistic styles include internal, stable, global attributions.

Among more than 300 volunteers, they found that perseverance and passion had different meaning, pleasure, and engagement orientations to happiness and implicit beliefs about willpower.

The research team is evaluating the relationship between “grit” and “growth mindset,” introduced by Stanford’s Carol Dweck to signify viewing failures and setbacks as opportunities to learn and improve, rather than a permanent lack of ability.

Dweck, with Lisa Blackwell, then of Columbia and University of Western Ontario’s Kali Trzesniewski demonstrated the impact of growth mindset and positive explanatory style on school motivation and achievement.

In addition, Duckworth and team are considering ability to delay gratification as a component of grit, since it has been associated with greater self-control and life accomplishment.

More grit may not always lead to greater accomplishment.
Duckworth and team speculate that grittier individuals may be:

  • More vulnerable to the “sunk-cost fallacy
  • Less open to information that contradicts their present beliefs
  • Handicapped by judgment and decision-making biases
  • Likely to new opportunities because they are tenaciously focused on the original goal.

Duckworth‘s colleague at Penn, Emilia Lahti is leading research on grit’s Finnish cousin, “Sisu,” implying perseverance, bravery and stamina, and should report her findings by the end of 2013.

Neuronal Recordings Suggest “Free Will” Might be “Free Won’t”

People may think they consciously control their actions and performance, but findings from UCLA’s Itzhak Fried and Roy Mukamel with Gabriel Kreiman of Harvard challenged conventional assumptions about “conscious intention” and “free will. ”

Fried, Mukamel, and Kreiman adopted Benjamin Libet’s procedure to assess “free will” at University of California, San Francisco, using intracranial recordings to identify neuron activity that precedes and predicts volunteers’ decision to move a finger.

Volunteers, who had electrodes implanted in their brains to record early indicators of seizures, pressed a button when they chose and indicated the clock’s hand position when they decided to press the button.

Libet’s process marks the time a voluntary action occurred, and the volunteer’s report of when the decision to act was completed.
These data points enabled researchers to identify specific neurons that were active during the time around the conscious decision to act and the completed action.

About a quarter of neurons in the frontal lobe’s supplementary motor area (responsible for motor activity coordination) and the anterior cingulate cortex (which directs attention and motivation) changed activity before volunteers said they wanted to press the button.

Spontaneous, voluntary acts were initiated in the cerebrum about 200 milliseconds before the person was consciously aware of the ‘decision’ to act, and researchers predicted with greater than 80 percent accuracy whether a movement had occurred and when the decision to make it happened.

Libet’s team suggested that unconscious brain processes, which are more rapid than conscious decision-making (“free will”), are the instigators of volitional acts.
However, these researchers also proposed that “free will” is more accurately described as “free won’t” because conscious volition can exercise “veto power” over intentions to act.

Kreiman extended this research to better understand loss of voluntary movement in Parkinson’s disease when he pre-empted volunteers’ movements after observing brain activation in the supplementary motor area and the anterior cingulate cortex.
StopHe activated a “stop” sign on a screen in front of each volunteer before the person actually moved, and reported that his volunteers frequently said, ”That was weird. It was like you read my mind.”

These brain studies complement Stanford professor Nalini Ambady’s work at Harvard University on “thin slicing”, or the experience of “knowing before you know.”
Also described as “intuition” or “unconscious cognitive processing,” these findings suggest that the conscious mind is the last to know when we make a decision.

Is Optimistic View of the Future Associated with Disabilities, Shorter Life Expectancy?

Frieder Lang of the University of Erlangen-Nuremberg and German Institute for Economic Research and his colleagues challenged the robust, replicated finding that optimism is associated with positive health outcomes.

Lang with University of Zurich’s David Weiss and Denis Gerstorf of Humboldt-University of Berlin and German Institute for Economic Research examined data from 1993 to 2003  German Socio-Economic Panel household surveys.

The team collaborated with Gert Wagner of German Institute for Economic Research and Max Planck Institute for Human Development evaluated approximately ratings from 40,000 people 18 to 96 years old, concerning their current and predicted life satisfaction in five years.

Their disruptive finding is that participants who expected highest life satisfaction in five years were more likely to experience disability and death within the following decade.

Five years after the first interviews:

  • 43 percent of participants were more satisfied with their lives than predicted,
  • 25 percent predicted accurately
  • 32 percent overestimated their life satisfaction with an optimistic bias.

Lang, Weiss, Gerstorf, and Wagner calculated that overestimating future life satisfaction was related to a 9.5 percent increase in reporting disabilities and a 10 percent increased incidence of death.

The youngest participants had the most optimistic outlook, whereas middle-aged adults made the most accurate predictions, but became more pessimistic over time.

Older adults’ predictions of future life satisfaction may be more accurate, albeit less optimistic, consistent with Shelley Taylor, Ellen Langer, Lauren Alloy, Lyn Abramson and others demonstration of an “optimism bias” and “depressive realism.”

In contrast to findings that higher income is associated with better health outcomes, Lang’s team found that stable, good health and income were associated with expecting a greater decline compared with those in poor health or with low incomes.
In contrast to other findings, higher income was related to a greater risk of disability.

Lang and team concluded that the outcomes of optimistic, accurate or pessimistic forecasts may depend on age, available resources, and motivation to adopt health-improving behaviors.
They acknowledged that unrealistic optimism about the future may help people feel better when they are facing inevitable negative outcomes, such as terminal disease.

Similarly, Neil Weinstein of Rutgers found that people may underestimate susceptibility to harm from a variety of hazards.
Close to 300 volunteers across age, gender, educational levels and occupational groups, demonstrated an optimism bias that they were less at risk than peers.

Weinstein hypothesized that optimism bias may be introduced when people extrapolate from their past experience to estimate their future vulnerability.
Therefore, volunteers future expectations may be biased  because they tended not to expect problems they had not already experienced.

He demonstrated that these personal risk judgments were not correlated with volunteers’ actual objective risk factors, suggesting that volunteers did not modify their optimistic biases based on laboratory findings, physical examination, and reported health habits.
Positive illusions persist even in the face of contradictory evidence.

These findings that optimistic bias may not be associated with positive health outcomes contrasts with findings from including University of Michigan’s Eric S Kim, Nansook Park, and Christopher Peterson, who found that “Dispositional Optimism” protects older adults from stroke.

Similarly, George Patton and colleagues at Royal Children’s Hospital in Parkville, Victoria, Australia reported that optimism has a somewhat protective effect on adolescent health risks in a prospective study.

Yet another counterpoint to Lang and team’s work was offered by Eric Giltay and colleagues at Leiden University Medical Center Johanna Geleijnse, Frans Zitman, Brian Buijsse, and Daan Kromhout, who demonstrated that optimists typically report healthier habits, like less smoking and drinking alcohol, more physical activity and consumption of fruit, vegetables and whole-grain bread.
